Know the Rules for the State of Washington!

  • Where can you smoke in Washington?

    You are allowed to smoke in your home or any other private establishment with permission from the owner, and out of the view of the public. You are allowed to smoke with other adults over the age of 21 away from children.

  • What about people from another state?

    Residents and Non-Residents alike can purchase cannabis as long as they are over the age of 21. Traveling between state lines is still illegal even if cannabis is legal in another state or if you are an out of state visitor. Breaking these rules can result in civil penalties, fines, community service and possibly jail time.

Usable Marijuana

“Usable marijuana” accounts for both dried cannabis flower and extracts (oil, vape pens, hash oil) as a usable product.

Marijuana Infused Product

Infused products are items that contain cannabis or cannabis extracts and are intended for human use only. This could include things that you eat or drink, like baked goods, candy, or sodas. While they can contain oil they are considered “Infused” rather than “Usable Marijuana” because they are not an isolated product.


The Washington State Liquor Control Board maintains a list of the weed-infused products that are currently approved.

How much Marijuana can I possess?

If you are 21 years of age or older in Washington State, you will not be prosecuted under state law for the possession or use of

  • Up to 16 ounces of solid marijuana-infused product
  • Marijuana-related paraphernalia
  • Up to 72 ounces of liquid marijuana-infused product
  • Up to one ounce of usable marijuana

Where you Can’t

  • In public and in view of the general public.
  • At the retail shop where you bought it.
  • If you can’t smoke tobacco somewhere, it will be illegal to smoke anything else there as well. (Most hotels and places of business also have no smoking policies.)
  • Marijuana use and possession is still against federal law (national law). Many popular visitor attractions in Washington State are on federal land, including national parks, national monuments, national wildlife refuges, and national forests.
  • Military and Department of Energy lands are also federally owned.
  • Many mountain ski slopes are located on federal land.
  • Restaurants, lounges, clubs, bars, sports stadiums, and concert venues.
  • You definitely can’t smoke pot while driving a car, or even when a passenger. (It would also be asking for trouble to smoke weed in a parked car.)
